Aug 2016_Holstead_New Clean H2O Rule

The students we sponsored at the SAME Construction Camps will briefly update us on their experiences prior to our lunchtime presentation.

The New Clean Water Rule became effective on August 28, 2015; however, there have been many changes and roadblocks since that time which have delayed the implementation of the new rule.  As currently published, the new rule has the potential to greatly affect development timelines for projects as a result of potential changes to the Section 404 Regulatory Program managed by the U.S. Army Corps of Engineers.  As a result of legal opposition to the rule, the rule has been stayed and is currently not in effect, but that could change quickly.

This presentation will cover:
– history of the rule making process
– the new definition of Waters of the U.S. (including new definitions of terms such as “tributary” and “neighboring”)
– what it means for the regulatory agencies, the public, and the private sector

The presentation will clarify the new rule, set regulatory expectations, and forecast tendencies.  Anyone who works with any aspect of land use needs to know about this rule.

Carland Holstead is a Senior Biologist and the Natural/Cultural Resources Department Manager in Terracon’s Dallas, Texas office.  He holds the Professional Wetland Scientist (PWS) certification which is given by the Society of Wetland Scientists. He oversees practices including wetland and stream determinations and delineations, U.S. Army Corps of Engineers permitting, mitigation plan development, threatened and endangered species habitat assessments, migratory bird surveys, NEPA assessments including CEs, EAs, and EISs, and Cultural Resources Assessments. Prior to joining Terracon, Carland served as a Regulatory Specialist for the U.S. Army Corps of Engineers, a marine scientist for the National Marine Fisheries Service, and a teacher. While working for the U.S. Army Corps of Engineers, Carland evaluated permit applications and issued permits for a multitude of projects, assisted with internal regulatory initiatives, and performed regulatory program educational outreach to the public.  Carland has a B.S. in Marine Biology from the University of Southern Mississippi and a M.S. in Marine Resources Management from Texas A&M University.
